Prayer: Writ Petition filed under Article 226 of the Constitution of India seeking issuance of writ of mandamus, directing the respondents 1 to 3 to disconnect the electricity service connection No.04-430-024-390 stands in the name of the 4^th respondent in the petitioner’s patta land in SF. No.9/14 at Pattipadi Velur Village, Yercaud, Salem District within the reasonable time.

ORDER

This Writ Petition has been filed seeking issuance of writ of mandamus, directing the respondents 1 to 3 to disconnect the electricity service connection No.04-430-024-390 stands in the name of the 4^th respondent in the petitioner’s patta land in SF. No.9/14 at Pattipadi Velur Village, Yercaud, Salem District

The learned counsel appearing for the petitioner would submit that the petitioner is the owner of the subject property and when he was in possession of the property, 4^th respondent by producing forged and fabricated document obtained electricity service connection for the Survey No.9/14 which belongs to the petitioner herein. He would further submit that the 4^th respondent obtained electricity connection for his Well situate in his land but, the survey number of the Well is different, which is 462/3 however, by referring the petitioner’s Survey No.9/14, 4^th respondent obtained electricity service connection. Hence, the petitioner filed this writ petition.

3. The learned Standing Counsel appearing for the respondents 1 to 3 would submit that the respondents will consider on those aspect and pass appropriate orders.

4. Heard the learned counsel for the petitioner as well as the respondents

1 to 3. None appeared on behalf of the 4^th respondent.

5. As per the averments of the petitioner, it appears that there is some discrepancies in the survey numbers in which the Well is situated. In such being the case, the respondent concerned is directed to conduct enquiry after giving notice to the 4^th respondent and ascertain whether the Well is situated at Survey No.462/3 or Survey No.9/14 and accordingly, correct the same. In the event any document is produced by VAO or Tahsildar with regard to the survey numbers, after receipt of the same, the authority concerned shall take necessary steps to correct the survey numbers as per the documents. In the event none appears for the 4^th respondent, it is open to the 3^rd respondent to pass appropriate orders, in accordance with law.

6. This Writ Petition is disposed of with the above terms. No costs.
