Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, to direct the first and second respondents to remove the encroachment made by the respondents 3, 4 & 5 in pursuance of their communique in Na.Ka.No.1316/2023/F1 coupled with the petitioner's representation dated 06.08.2025 in respect of Town Survey No.83 & 84 in Ward-B, Block No.14 ie. the front portion of petitioner's property which is a promboke land within a time frame as specified by this Court.

ORDER

(Order of the Court was made by N.SATHISH KUMAR, J.)

This writ petition has been filed seeking a direction to the first and second respondents to remove the encroachment made by the respondents 3, 4 & 5 in pursuance of their communique in Na.Ka.No. 1316/2023/F1 coupled with the petitioner's representation dated 06.08.2025 in respect of Town Survey No.83 & 84 in Ward-B, Block No. 14 ie. the front portion of petitioner's property which is a promboke land, within a time frame.

2.The learned counsel appearing for the second respondent would submit that they have already identified the encroachment and one R.Rajesh Kannan has filed a writ petition in WP.(MD)No.3533 of 2026, which was disposed on 09.02.2026 with a direction to remove the encroachment.

3.The learned counsel appearing for the fifth respondent would submit that the fifth respondent has been given assignment patta in Na.Ka.No.8809/2014/Aa2 and he is not an encroacher.

4.Considering the above submissions, let the official respondents to conduct survey in the presence of the petitioner as well as the fifth respondent and identify the area. After conducting survey, if it is found that there is an encroachment, the same shall be removed, within a period of three months. Accordingly, this writ petition is disposed of.
