O R D E R

The petitioner has filed this writ petition seeking issuance of Writ of Mandamus directing the respondent to consider the representation dated 08.10.2024.

2.The learned counsel appearing for the petitioner submitted that the petitioner mortgaged self acquired property with the first respondent along with his son and repaid the entire loan amount, however, the first respondent is not returning the original document to the petitioner.

3.The learned counsel appearing for the first respondent submitted that there is dispute between the petitioner and his son and the petitioner’s son is the co-borrower along with the petitioner, thereby the original document was not returned to the petitioner.

4.The learned counsel appearing for the second respondent submitted that this Court may issue direction to the first respondent to return the original sale deed in favour of the petitioner and grant liberty to the second respondent/ son to file civil suit against the petitioner/ father for recovery of the amount paid by the second respondent for settlement of the loan amount or for partition of property.

5.In view of the submission made by the learned counsel appearing for the second respondent, this Court directs the first respondent to return the original documents to the petitioner. Liberty is granted to the second respondent to work out the remedy as against the petitioner in the manner known to law.

6.The writ petition is disposed of. No costs.
