Prayer: Writ Petition filed under Article 226 of the Constitution of India, seeking issuance of writ of certiorarified mandamus, calling for the concerned records relating to the order in Na. Ka. No. NH1/ 554/ 2018 dated 10.07.2019 passed by the 2nd respondent and quash the same and consequently direct the respondents to relocate the Toll Plaza from the petitioners’ land in Survey No.116/1A, in Managethi Village, Udayarpalayam Taluk, Ariyalur District to an extent of 0.57.5 hectares to the adjacent Government Poramboke Lands and other benefits.

ORDER

This Writ Petition has been filed challenging the impugned order dated

10.07.2019 pass by the 2nd respondent, rejecting the petitioners’ objection to the

3(c) enquiry notice.

2.The learned counsel for the petitioners would submit that the respondent by issuing notification under Section 3(A)(1) were acquired the petitioners’ land for the purpose of putting up a toll plaza. Though the petitioners made objection to the same, the same was rejected by the respondents vide order dated 10.07.2019. Challenging the same, the present writ petition is filed.

3. However, the learned Additional Government Pleader appearing for the respondents would submit that due to the further development, the prayer in this writ petition has become infructuous. She would submit that the Toll Plaza was set up and it is in operation from 27.05.2022 therefore, she would submit that nothing survives in this case.

4. Heard the learned counsel appearing for the petitioners as well as the respondents and perused the material available on record.

5. As rightly contended by the learned counsel for the respondents, in the present case, challenge is with regard to the enquiry but subsequently, order has also been passed and the Toll Plaza has been set up and it is in operation. Under these circumstances, the learned counsel for the petitioners would submit that they have not received order copy.

6. In such being the case, the respondent concerned is directed to serve copy of the order passed by the respondents within a period of four weeks from the date of receipt of a copy of this order. If the petitioners are aggrieved by the order, they are at liberty to to challenge the same in the manner known to law.

7. This Writ Petition is disposed of with the above terms. No costs.

Consequently, connected miscellaneous petitions are closed.
