NIRMAL KUMAR N.Aruchamy ..Petitioner Vs S.P.K.Kathiresan ..Respondent PRAYER: The Criminal Original Petition filed under Section 528 of BNSS, 2023, to direct the learned Judicial Magistrate No.I, Pollachi, Coimbatore District, to expedite and dispose of C.C.No. 13 of 2020 within a time frame to be fixed by this Court.

ORDER

The Criminal Original Petition has been filed by the complainant in a case under Section 138 of the Negotiable Instruments Act, 1881, seeking a direction to the learned Judicial Magistrate No.I, Pollachi, Coimbatore District, to expedite and dispose of C.C.No. 13 of 2020 within a stipulated time.

2. On 09.03.2026, this Court had questioned the learned counsel for the petitioner with regard to the status of the case, he was unable to give any clarification, instead he sought short accommodation. It would be apposite to extract the order of this Court dated 09.03.2026 which reads as under:

"The petitioner, as complainant, had filed a case under Section 138 of the Negotiable Instruments Act, 1881, before the Judicial Magistrate Court No.I, Pollachi, in C.C.No.13 of 2020.

2. From the adjudication furnished by the petitioner in the typed set, it is seen that on 20.02.2020 initial questioning under Section 251 Cr.P.C. is completed. Thereafter, the case was posted for trial and adjourned to several hearing till 19.09.2023. From 19.09.2023 the case has been adjourned for evidence till

12.12.2025.

3. When the learned Counsel for the petitioner, who appeared through Video Conferencing, was questioned with regard to the further progress of the case, he submitted that from 20.02.2026 the case was adjourned to today (09.03.2026) for further examination of witnesses on the complainant's side and the case is posted today and he is unable to give all the details. The learned counsel for the petitioner is directed to collect all the details and furnish the same.

4. Post the matter on 11.03.2026."

3. Today when the matter was taken up for hearing, there was no representation for the petitioner. Therefore, this Criminal Original Petition is dismissed.
