PRAYER : Writ Petition has been filed under Article 226 of Constitution of India praying to issue a writ of mandamus directing the respondents to pay difference in pension for the period of June 2024 to July 2025; to pay the petitioner the arrears of difference in dearness allowance for the period of January 2018 to May 2024; to pay the difference in surrendered earned leave wages together with interest at the rate of 12 percent per annum and to pay the petitioner interest at the rate of 12 percent per annum for the belated payment of Rs.21,23,226/- towards PF and for the belated payment of Rs.2,76,457/-

towards earned leave / medical leave salary, within a specified time frame.

ORDER

The writ petition is filed for the relief set out below:

"directing the respondents to pay difference in pension for the period of June 2024 to July 2025; to pay the petitioner the arrears of difference in dearness allowance for the period of January 2018 to May 2024; to pay the difference in surrendered earned leave wages together with interest at the rate of 12 percent per annum and to pay the petitioner interest at the rate of 12 percent per annum for the belated payment of Rs.21,23,226/- towards PF and for the belated payment of Rs.2,76,457/- towards earned leave / medical leave salary, within a specified time frame."

2. The brief facts which has culminated in the filing of this writ petition are set out below:

2.1. It is the case of the petitioner that the petitioner joined the services of the 1^st respondent corporation as a Driver. It is the contention of the petitioner that the Dearness Allowance was revised as per the periodical settlement. 2.2. He further submits that retirement benefits were also to be disbursed taking note of the said revision in Dearness Allowance. However, the said increase was not taken into consideration while calculating his retirement benefits. In addition to this, the petitioner was settled with his terminal benefits with a delay of 600 days. Therefore, the respondents are legally bound to pay interest to the petitioner. Therefore, the petitioner made a representation to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of the petitioner’s terminal benefits and to pay him the differential payment with interest. However, the same had not been considered to date by the respondents.

Hence, the petitioner is before this Court.

3. Heard the learned Counsel on either side and perused the records.

4. Admittedly, the terminal benefits has been paid belatedly for no fault of the petitioner. Therefore, the petitioner is entitled to interest on the same. Considering the limited request of the petitioner and taking note of the fact that the petitioner's representation has not been considered to date by the Respondents, a mandamus, is therefore, issued to the respondents to pay the difference in pension for the period of June 2024 to July 2025; to pay the petitioner the arrears of difference in dearness allowance for the period of January 2018 to May 2024; to pay the difference in surrendered earned leave wages together with interest and to pay the petitioner interest at the rate of 6 percent per annum for the belated payment of Rs.21,23,226/- towards PF and for the belated payment of Rs.2,76,457/- towards earned leave / medical leave salary, from the said date of entitlement to till the date of actual disbursement
