ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents 1 to 2 to transfer the patta based on the petitioner's representations dated 07.11.2024 and 27.02.2026.

2. The petitioner's husband owned certain family properties . There were partition among the petitioner's husband, the fourth respondent, and their mother through a registered partition deed dated 13.11.2002, in Document No. 668/2002. In the said partition deed, the 'C' Schedule was allotted to Subbaiyan, the petitioner's husband. In the 'C' Schedule, Survey Nos. 22/1, 22/11, and 22/16 were allotted to the petitioner's husband. Subsequently, the said properties were settled in favour of the petitioner through a settlement deed dated 21.06.2006. When the properties were allotted to the petitioner's husband, the respondents had wrongly issued patta for Survey Nos. 22/11 and 22/16 in the name of the fourth respondent. Therefore, the petitioner is seeking modification of the same and issuance of a fresh patta in the name of the petitioner in Patta No.1430. The respondents have issued patta insofar as Survey No. 22/1 is concerned, but the same has to be issued as an individual patta in favour of the petitioner.

In view of the above, the first respondent is directed to consider the petitioner's representations and to conduct an enquiry after issuing notice to the petitioner as well as the fourth respondent and thereafter, pass appropriate orders. While considering the same, the respondent shall take into account the partition deed. The said exercise shall be completed within a period of twelve weeks from the date of receipt of a copy of this order.

4. With the above directions, this Writ Petition is disposed of. There shall be no order as to costs.
