ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to direct the respondents to issue patta to the petitioners in respect of the lands bearing S.No.27/1G and 27/4A situated at Elanthaikulam Village, Othakadai, Madurai, by considering the representation given by the petitioners dated 21.10.2024 and 09.02.2026 within a time frame stipulated by this Court.
2. The contention of the petitioners is that Survey Nos. 27/1G and 27/4A were initially allotted to members of the Adi Dravidar Community as early as 1985. Since there was a violation of the assignment conditions, the assignment was cancelled. Subsequently, in the year 2002, the lands were again assigned to nine persons belonging to the same Adi Dravidar Community. The said assignment was also cancelled for violation of conditions, vide order dated 28.06.2024. At present, the land is lying vacant. Some of the petitioners had put up huts and were residing there for four to five years. However, the huts were put up without obtaining any prior permission from the competent authority. The respondents demolished the said huts. Hence, the present writ petition has been filed seeking a direction to the respondents to consider the petitioners' plight and assign patta for the said land.
3. This Court without expressing any opinion on merits is directing the respondents to ascertain the financial status of the petitioners. If they come within the purview of the eligibility criteria, the respondents may allot the land to the petitioners. The petitioners further submitted that there are 78 other families in the said area. The respondents may also consider those families, if they come within the purview of the eligibility criteria.
4. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
