ORDER
The present Writ Petition has been filed for the issuance of a Writ of Mandamus, directing the respondents to cancel the pattas standing in the names of private individuals and to issue patta in favour of the petitioner Ashram in respect of Survey No. 976/3, measuring 2 Acres and 54 Cents, Palani Village, as per the decree and judgment of the learned Principal Sub Judge, Palani, in A.S. No. 12 of
2018 and A.S. No. 13 of 2018.
2. According to the petitioner, the land originally belonged to the Petitioner's Ashram. However, the third respondent claims right over the property. The petitioner had filed O.S. No. 373 of 1996 on the file of the District Court, Palani. The alleged encroachers, in turn, filed O.S. No. 1235 of 2004 and O.S. No. 211 of 2012, and the said suits were dismissed. The suit filed by the petitioner Ashram was decreed. Aggrieved by the judgment of the Trial Court, the third parties preferred appeals in A.S. No. 12 of 2018 and A.S. No. 13 of 2018 on the file of the Principal Subordinate Judge, Palani, and the same were also dismissed.
Thereafter, no second appeal has been preferred and the litigation has attained finality. Hence, the petitioner is seeking to consider the petitioner's representation for cancellation of the patta standing in the name of the third respondent. The third respondent was already issued notice and the same is pending enquiry. 3. Therefore, the second respondent / Tahsildar is directed to consider the the petitioner's representation and to complete the enquiry within a period of eight weeks from the date of receipt of a copy of this order.
4. With the above observations, this Writ Petition is disposed of. There shall be no order as to costs.
