ORDER

The petitioner has retired from service as Senior Draftsman, on

31.01.2010. The petitioner has submitted a representation for revision of scale of pay by awarding selection grade and also sought for benefits of notional increment and pension benefits. A proposal was sent by the fourth respondent to the third respondent, on 17.03.2020. Therefore, the petitioner has filed this writ petition seeking a direction to the third respondent to implement the proposal sent by the fourth respondent.

2.The learned Additional Government Pleader appearing for the respondents 1, 2, 4 and the learned counsel appearing for the third respondent, by referring to the counter affidavit filed by the respondents 1 to 4, submit that the pay of the petitioner was refixed by awarding the selection grade and the pension and DCRG were enhanced by the third respondent vide his proceedings dated 05.01.2021 and the petitioner is receiving the enhanced pension and the DCRG as per his entitlement. Further the petitioner's request for granting notional increment as on 01.04.2010 could not be considered, since he has not completed one year of service on the date of his retirement on 31.01.2010 but has rendered only 10 months service and hence, his request to grant notional increment was rejected, vide office Memo in O.Mu/5203/2019/A3 dated 19.11.2019 and the same was intimated to the petitioner.

3.Recording the above submission, this writ petition is closed.

No costs. Consequently, connected miscellaneous petitions are also closed.
