O R D E R

The petitioner /Village Assistant of Manalur Village has been placed under suspension and the same is under challenge in this writ petition.

2.The learned counsel appearing for the petitioner submits that based on a criminal case, which has been registered as against this petitioner, in Crime No.147 of 2025, on the file of Thiruppanandal Police Station, he has been placed under suspension. According to the learned counsel, this petitioner has nothing to do with the case in Crime No.147 of 2025, however, this petitioner has been added as an accused, based on a statement of a witness, who had motive as against this petitioner. He also claimed that the petitioner has not been provided with the subsistence allowance during the suspension period and therefore, he has approached this Court.

3.The learned Additional Government Pleader appearing for the respondents submits that this petitioner is working as Village Assistant at Manalur Village. In a temple festival celebrated at Manalur Village on 07.07.2025, there was a clash between two community people. In this regard, a criminal case was registered in Crime No.147 of 2025 on the file of Thiruppanandal Police Station, for the offences punishable under sections 296(b), 115(2), 324(4), 351(3), 191(2), 191(3) of BNS r/w Section 4 of the Tamil Nadu Prohibition of Harassment of Woman (Amendment) Act, 2025. This petitioner is also one of the accused in the above crime number. He also submitted that this petitioner was arrested on 30.07.2025 at about 5:15 pm and he was detained in prison, in view of his involvement in a criminal case and his arrest. The respondents have proceeded by initiating a disciplinary proceedings as against this petitioner, by placing him under suspension, by the order impugned in this writ petition dated 22.08.2025. With regard to the averment made by the petitioner that he has not been paid with subsistence allowance, the learned Additional Government Pleader submits that necessary steps are taken to provide the subsistence allowance to the petitioner.

4.This Court considered the rival submissions made and also perused the materials placed on record.

5.The petitioner, a Village Assistant was arrested pursuant to a Criminal case in Crime No.147 of 2025 and he was also detained in Sub Jail, Pudukkottai for more than 48 hours. Therefore, the respondents have placed him under suspension. In view of the above, this Court is not inclined to entertain this writ petition.

6.Accordingly, this writ petition is dismissed. However, this petitioner is entitled for subsistence allowance during his suspension period and therefore, the respondent Department shall ensure that this petitioner is paid with the subsistence allowance, within a period of one week from the date of receipt of copy of this order. No costs. Consequently, connected Miscellaneous Petition is closed.
