K.Nithya – Appellant
Versus
The State of Tamil Nadu – Respondent
W.M.P.Nos.13810 & 13811 of 2026
For the Appellants/Petitioners: Ms.V.Srimathi
For the Respondents: Mrs.C.Meera Arumugam Additional Government Pleader
Court directs consideration of representation for panchayat inclusion within time frame without prejudice.
Headnote:The petitioner challenged a notification dated 08.12.2025 under Section 15(2) of the Tamil Nadu Panchayats Act, 1994, and consequential G.O.(Ms) No.58 dated 27.02.2026, seeking to quash them and restore Nallappalayam Village Panchayat. The court noted the petitioner's representation dated 11.12.2025 for inclusion of the panchayat was not considered. The court directed consideration without expressing merits. The issue framed was whether to quash the notification or consider the representation for inclusion. The ratio decidendi is that administrative authorities must consider representations on merits within a time frame, causing no prejudice to respondents when no decision has been taken. The writ petition is disposed of by directing the first respondent to pass final orders on the representation within eight weeks.

2. Mrs.C.Meera Arumugam, learned Additional Government Pleader, accepts notice on behalf of the respondents.
3. Even though the aforesaid notification and the G.O. has been challenged in this writ petition, learned counsel for the petitioner, on instructions, would now submit that, it would suffice if the representation of the petitioner dated 11.12.2025 seeking inclusion of Nallappalayam Panchayat in the notification, which is challenged in this writ petition, is considered on merits and in accordance with law, within a time frame to be fixed by this Court.
