Mandamus issued directing consideration of representation for contractual employee's regularization on merits within time frame.

ORDER

Mr.M.Bindran, learned Additional Government Pleader accepts notice on behalf of the respondents 1 and 2.

2.With the consent of the learned counsels on either side, the writ petition is taken up for final disposal.

3.The petitioner has come forward with this writ petition seeking a mandamus to the respondents to consider and dispose of his representation dated 02.02.2026, within a time frame to be stipulated by this Court.

4.The case of the petitioner is that after completing one year Health Inspector Diploma Course conducted by R.M.College of Paramedical Science, Pondicherry, he registered the same with the Employment Exchange. Subsequently, he was appointed as Health Inspector Grade-II on contract basis and he working in various Primary Health Centres. The petitioner also received the Covid Duty Certificate for his hard and sincere work during Covid Pandemic period. While so, on completion of the contract period, he was relieved from the post of Health Inspector Grade II. The 2^nd respondent, vide letters dated 10.08.2016, 22.06.2017 and 28.08.2017, requested the Government of Puducherry, to fill up the vacancies by relaxing the relevant adhoc rule and the Government, vide G.O.Ms.No.337, Health and Family Welfare [L1] Department, dated 02.08.2019, gave one time relaxation of Rule 5[b] of the Adhoc rule. Hence, the petitioner submitted a representation on 02.02.2026, requesting the respondents to consider his case for the purpose of appointment to the post of Health Inspector Grade II, on par with 93 persons who have been appointed to the said post, with similar qualification of completion of one year Diploma Course, vide appointment order dated 22.12.2025. Since the representation is yet to be considered, the petitioner has filed the above writ petition for the aforesaid relief.

5.Heard both sides and perused the materials on record.

6.Considering the limited scope of the prayer sought for by the petitioner, this Court, without going into the merits of the case, directs the 2^nd respondent to consider and dispose of the petitioner’s representation dated 02.02.2026, on merits and in accordance with law, within a period of six weeks from the date of the receipt of a copy of this order.

7.The writ petition is disposed of accordingly. No costs.
