The Sub Registrar, Sub Registrar officer, Srirangam. ...Respondents Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned refusal check slip issued by the 3rd respondent in her proceedings Refusal No.RFL/Srirangam/146/2025 and also issued refusal order in her proceedings in Na.Ka.No.29/2025 in Refusal dated 15.12.2025 and quash the same as illegal and consequently direct the 3rd Respondent to register the Sale deeds or settlement deeds or MOD or any other documents when it presented for registration by the petitioner with respect to the subject property bearing in T.No.1498/1B in Ward No.1, Block No.45 in T.D No. 1050 at measuring to an extent of 1260 Sqft on the northern portion of vacant land was comprised in Plot No. 18 was situated in the layout known Sri Vyasaraja Nagar at Thimmarayasamuthiram Village, Srirangam, Trichy District, without insisting No Objection Certificate from the 1st and 2nd Respondent or any other and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.

ORDER

The present writ petition has been filed for the following relief:- “Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a Writ of Certiorarified Mandamus to call for the records relating to the impugned refusal check slip issued by the 3rd respondent in her proceedings Refusal No.RFL/Srirangam/146/2025 and also issued refusal order in her proceedings in Na.Ka.No.29/2025 in Refusal dated 15.12.2025 and quash the same as illegal and consequently direct the 3rd Respondent to register the Sale deeds or settlement deeds or MOD or any other documents when it presented for registration by the petitioner with respect to the subject property bearing in T.No.1498/1B in Ward No.1, Block No.45 in T.D No. 1050 at measuring to an extent of 1260 Sqft on the northern portion of vacant land was comprised in Plot No. 18 was situated in the layout known Sri Vyasaraja Nagar at Thimmarayasamuthiram Village, Srirangam, Trichy District, without insisting No Objection Certificate from the 1st and 2nd Respondent or any other and pass such further or other orders as this Hon'ble Court may deem fit and proper in the circumstances of the case and thus render justice.”

2. Heard Mr.K.Mahendran, learned counsel appearing for the petitioner, Mr.M.Gangatharan, learned Government Advocate, who takes notice for R1 and R3 and Mr.M.Saravanan, learned counsel, who takes notice for R2.

3. Considering the objections received to the effect that the land is a temple property and in view of certain earlier proceedings, the impugned refusal check slip has been issued. It can be seen that whenever any objection is raised under Section 22-A of the Registration (Tamil Nadu Amendment) Act, claiming that the property belongs to a temple, an order cannot be passed straightaway but an enquiry in the matter has to be conducted since the matter has been settled by the Hon'ble Division Bench of this Court in Sudha Ravi Kumar and another vs. The Special Commissioner and Commissioner, Hindu Religious and Charitable Endowments Department, Chennai and others, reported in (2017) 3 CTC 135.

4. In view thereof, this writ petition is allowed on the following terms:-

i. The impugned refusal check slip dated 15.12.2025 shall stand set aside and the
