For Petitioner : Mr.S.Santhosh For R1 : Mr.Leonard Arul Joseph Selvam, Additional Public Prosecutor assisted by Ms.Harshana.T For R2 : Mr.C.Divesh Kumar ORDER The petitioner, who is an accused in FIR in Crime No.14 of 2025 dated 18.03.2025 for offence under Sections 78, 308(2) & 351(2) and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 on the file of the 1st respondent Police, has filed this Criminal Original Petition on the ground of compromise.
2.Case of the prosecution is that the 2nd respondent is studying 5th year at Government Law College, Vellore. Before this, when she was studying at Dharmapuri Government Law College, the petitioner proposed his love to her which she refused initially. Thereafter, the 2nd respondent accepted the proposal of the petitioner. Due to the petitioner’s inappropriate action, the 2nd respondent broke up the petitioner and got transfer to Vellore Government College because of the petitioner’s torture. The petitioner, who is practising in Krishnagiri District Court, not only threatened the 2nd respondent but also threatened her family members to give money and also hacked the 2nd respondent’s mobile phone. On the complaint of the 2nd respondent, the 1st respondent Police registered FIR in Crime No.14 of 2025 for offence under Sections 78, 308(2) & 351(2) and Section 4 of Tamil Nadu Prohibition of Harassment of Women Act, 2002 against the petitioner.
3.The case is at the stage of investigation. By passage of time, the parties have decided to bury their hatchet and compromise the dispute amicably among themselves.
4.Today the petitioner and the 2nd respondent appeared before this Court and their identity is confirmed by Ms.V.Kavitha, Special Sub Inspector attached to the 1st respondent Police Station. This Court also enquired both the parties and was satisfied that the parties have come to an amicable settlement between themselves. The 2nd respondent informed that due to misunderstanding and difference of opinion, their friendship became strained and the dispute was purely personal in nature and now she is not willing to further proceed with the case and filed an affidavit to that effect. The petitioner and the 2nd respondent have filed separate affidavit before this Court.
5.Under such circumstances, no useful purpose will be served in keeping the First Information Report pending, even though, the offences involved are not compoundable in nature. In the light of the guidelines given by the Hon'ble Supreme Court reported in 2017 9 SCC 641- (Parbathbhai Aahir @ Parbathbhai Vs. State of Gujrath), and after exercising due caution as advised by the Hon'ble Suprme Court in The State of Madhya Pradesh v. Dhruv Gurjar and Another reported in (2019) 2 MLJ Crl 10), this Court in exercise of its jurisdiction under Section 482 Cr.P.C., is inclined to quash the FIR.
6.This Criminal Original Petition stands allowed and as a sequel, the FIR in Crime No.14 of 2025 dated 18.03.2025 on the file of the 1st respondent Police is quashed against the petitioner. Consequently, connected Criminal Miscellaneous Petition is closed.
