ORDER

The writ petition is filed seeking a mandamus to the respondent to settle the retirement benefits payable to the petitioner @ 6% interest, by considering the petitioner’s representation dated 11.12.2025.

2. It is the case of the petitioner that he joined the service of the respondent Corporation on 23.12.1998 and retired from service, on attaining the age of superannuation, on 31.12.2025. According to the petitioner, the respondent had not settled his retirement benefits. When enquired, he was informed that on behalf of the petitioner, a case in I.D.No.98 of 2019 before the Principal Labour Court, Coimbatore, seeking to regularise the service of the petitioner, on his completion of 240 days in service was filed by the Employees’ Association and this was challenged by the respondent- Corporation before this Court in W.P.No.11359 of 2023 and the same is pending. Therefore, on this ground, the petitioner’s retirement benefits was not settled. The petitioner has also submitted a representation on 11.12.2025 to the respondents to pay his terminal benefits. However, the same was not considered. Hence, the petitioner is before this Court.

3. It is also brought to the notice of the Court that in the said W.P.No.11359 of 2023, the respondent-Corporation has obtained an order of interim stay as against the Labour Court order, on condition that respondent/Corporation deposits 50% of backwages as ordered by the Labour Court.

4.Heard the learned counsel on either side and also perused the materials placed before this Court.

Considering the limited scope of prayer sought for in this writ petition, this Court without going into the merits of the case, directs the respondent to consider the representation of the petitioner, settle the terminal benefits which the petitioner is entitled to, as per his last drawn salary, along with interest permissible in law for the delayed period, within a period of two weeks from the date of receipt of a copy of this order. The parties should also take into consideration any order that is to be passed in W.P.No.11359 of 2023 as that writ petition has been filed challenging the award in I.D.No.98 of 2019.

6. With the above direction, the writ petition is disposed of. No costs.
