(C) No.339 of 2024 dated 08.01.2024 and consequently directing the respondents to consider the petitioner for promotion to the post of Assistant Commandant by placing him above his junior P.Sekar with all consequential service and monetary benefits.

Heard Mr.H.Mohammed Imran, learned counsel for the petitioner and Mr.V.Omprakash, learned Government Advocate appearing for the respondents.

2. With the consent of both sides, this Writ Petition is disposed of at the admission stage itself.

3. The petitioner herein was appointed as a Grade-II Police Constable on 01.03.1995 and was thereafter promoted from time to time.

Ultimately, he was promoted as Inspector of Police on 23.05.2023 in TSP XI Battalion, Rajapalayam, Virudhunagar District and is working as such as on date.

The petitioner claims to have come to know that one Mr.P.Sekar, who is junior to him in the cadre of Inspector of Police, had approached this Court by filing W.P.(MD) No.7511 of 2020 seeking refixation of his seniority by taking into consideration the marks secured by him in the Police Recruitment School, in conformity with Rule 24 of the Tamil Nadu Special Police Subordinate Service Rules, 1978. The said Writ Petition was allowed by this Court by an order dated 11.10.2022. According to the petitioner, by virtue of the said order, the said Sekar has become senior to him.

5. Therefore, the petitioner claims to have made a request for revision of his seniority on par with the said Sekar. The same was forwarded by the fifth respondent to the second respondent through a letter dated 18.02.2026 bearing reference Na.Ka.No.A1/8744/2025, and the same is pending consideration.

Hence, the petitioner has approached this Court by filing the present Writ Petition seeking issuance of a Writ of Mandamus directing the respondents to refix the seniority of the petitioner on the basis of the marks secured by him in the Police Recruitment School, in accordance with Rule 24 of the Tamil Nadu Special Police Subordinate Service Rules, 1978, on par with the benefit extended to similarly placed persons and consequently directing the respondents to consider the petitioner for promotion to the post of Assistant Commandant by placing him above his junior, Mr.P.Sekar, with all consequential service and monetary benefits.

The learned Government Advocate appearing for the respondents submits that the request made by the petitioner on 17.02.2026 was immediately attended to and that the same was forwarded by the fifth respondent to the second respondent through the third respondent on 18.02.2026 and that appropriate orders will be passed by the second respondent as expeditiously as possible.
