O RDER
This Criminal Original Petition has been filed under Sections 483(i)(b) and 528 of theBNSS, 2023, praying to set aside the order dated 12.09.2025 passed by the learned Additional District Judge, Principal Special Court forNDPS ActCases, Madurai, in Crl.M.P.No.3467 of 2025, and consequently to modify the condition requiring the execution of a bond with sureties imposed therein, and to permit the petitioner to be released on the execution of a personal bond without sureties.

The learned counsel appearing for the petitioner submits that the petitioner was granted bail on 10.01.2025 by the learned Additional District Judge, Principal Special Court for NDPS Act Cases, Madurai, in Crl.M.P.No.70 of 2025, with a condition that the petitioner shall execute a bond for a sum of Rs.10,000/- along with two sureties, among which one shall be a blood surety and another shall be a solvent surety. Subsequently, the petitioner filed a petition before the said Court in Crl.M.P.No.3467 of 2025 seeking modification of the said condition. By an order dated 12.09.2025, the learned trial Judge allowed the said petition, modifying the condition to the effect that the petitioner shall execute a bond for a sum of Rs.10,000/- along with two sureties, both of them shall be solvency. Since the petitioner is unable to produce solvent sureties, he seeks further modification of the condition imposed in Crl.M.P.No.3467 of 2025 dated 12.09.2025. He further submits that the petitioner is ready to execute a personal bond. Hence, he prays for modification of the said condition before this Court.

Considering the reasons stated by the petitioner in the present petition, this Court is inclined to modify the condition imposed on the petitioner in Paragraph No.5 of the order passed in Crl.M.P.No.3467 of 2025, dated 12.09.2025, by the learned Additional District Judge, Principal Special Court for NDPS Act Cases, Madurai. Accordingly, the same is modified to the effect that the petitioner shall execute a personal bond for a sum of Rs.10,000/- (Rupees Ten Thousand only) along with two sureties. All other conditions shall remain unaltered.
