Courts direct expeditious disposal of pending trials, enforcing prior time-bound orders for old cases.

O R D E R

The petitioner/defacto complainant in CC No.391of 2018, on the file of the learned Judicial Magistrate Court No.IV, Madurai has filed this petition, seeking a direction to the trial Court to conclude the trial in the above case, within a stipulated time.

2.The learned counsel appearing for the petitioner by referring to the earlier order passed by this Court in WP(MD) No. 16383 of 2018, dated 26.11.2024 submits that this Court has already issued a direction to the trial Court to conclude the trial within a period of six months from the date of receipt of a copy of that order. However, the trial in the above said case has not been concluded so far. Hence, he seeks a suitable direction.

3.Mr.R.Meeaksshi Sundaram, learned Additional Public Prosecutor, who takes notice for the respondent submits that the witnesses LW 1 to LW 9 were already examined and the case in CC No.391 of 2018 is posted to 23.04.2026 for examination of the investigating officer.

4.This Court considered the rival submissions made and also perused the materials placed on record.

5.Admittedly, the case in CC No.391 of 2018 is of the year 2018. The trial Courts are expected to give priority to the old cases. It is reported that this Court in WP(MD) No.16383 of 2018, dated 26.11.2024 has already directed the trial Court concerned to conclude the trial within a period of six months from the date of receipt of a copy of that order, however, the order of this Court has not been complied with. It is very unfortunate that the petitioner was constrained to file this petition for the very same relief, which was already granted by this Court. Since it is reported that the trial in CC No.391 of 2018 has been almost completed and it is posted for examination of the investigating officer alone, the learned Judicial Magistrate Court No.IV, Madurai is directed to conclude the trial in the above case, as directed by this Court, in its earlier order, dated dated 26.11.2024 in WP(MD) No.16383 of 2018.
