Revenue authorities must hear objections before mutating records when civil suit is pending over property.

O R D E R

This Writ Petition has been filed to direct the 1^st respondent not to mutate the revenue records any further in respect of the property morefully disclosed in the affidavit filed in support of this Writ Petition, since the Civil Suit is pending.

2.Admittedly, the Patta Nos.2408 and 3227 stand in the name of the respondents 2 to 4. A Civil Suit is also pending between the petitioner and the respondents 2 to 4. Since the Civil Suit is pending, the petitioner claims that the 1^st respondent cannot mutate the revenue records for the subject property any further till the disposal of the Civil Suit. This Court is not expressing any opinion on the merits of the petitioner’s contention.

3.The petitioner had given a representation on 18.11.2025, requesting the official respondents not to mutate the revenue records any further, due to the pendency of the Civil Suit. Since the said representation has not been considered, the petitioner has filed this Writ Petition.

4.Mr.C.Jayaprakash, learned Government Advocate, accepts notice on behalf of the 1^st respondent. Since no adverse orders are passed against the respondents 2 to 4 in this writ petition, notice to the respondents 2 to 4 is dispensed with. No prejudice would be caused to the respondents if the petitioner’s representation as stated supra is considered on merits and in accordance with law, after hearing the objections of the respondents 2 to 4 as and when any application has been submitted by the respondents 2 to 4 or any other third party pertaining to the subject property seeking for mutation of the revenue records.

5.Accordingly, this Writ Petition is disposed of by directing the 1^st respondent to issue notice to the petitioner and hear his objections as and when any application is filed by the respondents 2 to 4, or any other third party, seeking for transfer of Patta Nos.2408 and 3227 and only after hearing the objections of the petitioner, the official respondents shall consider any request for mutation of the revenue records any further, pertaining to Patta Nos.2408 and 3227. However, there shall be no order as to costs.
