Police must facilitate participation in village temple festivals against unlawful excommunication via enquiry and summons under BNSS.

Respondents PRAYER : Writ Petition filed under Article 226 of the Constitution of India for issuance of Writ of Mandamus, to direct the respondents 1 to 7 herein to take action against the 8^th respondent for excommunicating the petitioner and his family members from their own native village based on the petitioner's representation dated 16.04.2026 within a stipulated time of period fixed by this Court.

ORDER

Seeking to direct the respondents 1 to 7 herein to take action against the

8^th respondent for excommunicating the petitioner and his family members from their own native village, based on the petitioner's representation dated

16.04.2026, the present writ petition is filed.

2.The learned counsel for the petitioner submitted that, due to prior enmity, the petitioner and his family have been excommunicated from the village by the 8th respondent and have also been prevented from participating in the temple festival of 'Aanaichayee Amman Temple and Mariamman Temple' situated at Perumalpalayam Village. It was further submitted that a representation in this regard has been made to the competent authority.

However, the same has not been considered. Hence, the present petition.

3.The learned Additional Public Prosecutor submitted that proper enquiry would be conducted into the matter. He further submitted that there was no ex- communication and no temple festival is being conducted during the current year.

5.The learned counsel for the petitioner categorically contended that though the learned Additional Public Prosecutor claims that no festival is likely to be conducted, the same is scheduled to be held on 26.04.2026.

6.Considering the submissions made, the seventh respondent police is directed to issue summon on the petitioner as well as the 8^th respondent under Section 64 of BNSS forthwith, conduct enquiry and take appropriate steps to facilitate the participation of the petitioner and his group in the temple festival of Aanaichayee Amman Temple and Mariamman Temple situated at Perumalpalayam Village scheduled to be held on 26.04.2026.

7.It is made clear that the seventh respondent police should facilitate the petitioner and direct the 8^th respondent to obtain 'jiyflL; thp' from the petitioner and his group.

8.With the above directions, this Writ Petition is disposed of.
