Court directs prison authority to consider representation for humanitarian prisoner transfer within four weeks.
Headnote:Under Article 226 of the Constitution of India, the petitioner sought a writ of mandamus directing consideration of a representation for transfer of a prisoner from Vellore Prison to Madurai or Trichy Central Prison on humanitarian grounds. The court noted the receipt of the representation dated 04.02.2026. The court directed the first respondent to consider and pass orders on the representation in accordance with law within four weeks. The sole issue was whether to direct consideration of the representation for prison transfer. The ratio decidendi is that prison authorities must expeditiously consider representations for transfer on humanitarian grounds as per law. The writ petition is disposed as above.

The prayer in this Writ Petition is for a mandamus directing the Inspector General of Prison/R1 to consider the representation of petitioner’s mother Sivakumar @ Valaipazha Sivakumar, son of Govinthan, presently confined in Vellore Prison to be transferred to Central Prison, Madurai or Central Prison, Trichy on humanitarian grounds.
2. Mr.Muniyapparaj, learned Additional Public Prosecutor assisted by Mr.M.Sylvester John, learned counsel who accepts notice for the respondents accedes to the receipt of representation dated 04.02.2026.
3. Hence, it would be appropriate for R1 to consider the representation of the petitioner’s mother dated 04.02.2026 and we so direct R1 to consider and pass orders on the aforesaid representation, in accordance with law, within a period of four (4) weeks from today.
4. This Writ Petition is disposed as above.
