Mandamus issued directing consideration of representation for referring land acquisition compensation dispute to competent court under Tamil Nadu Highways Act.

ORDER

This writ petition has been filed seeking for a limited relief. The petitioner seeks for referring the matter to the competent Court to enable the petitioner to get enhanced compensation for the property more fully disclosed in the prayer to this writ petition, which were acquired under the Tamil Nadu Highways Act, 2001, by award dated 30.09.2013.

2. The petitioner had given a representation on 28.04.2014 to the first respondent for the aforesaid purpose. Since the same has not been considered, the petitioner has filed this writ petition.

3. Mr.D.Ravichander, learned Special Government Pleader, accepts notice on behalf of the respondents.

4. No prejudice would be caused to the respondents if a direction is issued to the first respondent to pass final orders on merits and in accordance with law on the petitioner’s representation dated 28.04.2014 within a time frame to be fixed by this Court.

For the foregoing reasons, this writ petition is disposed of by directing the first respondent to pass final orders on merits and in accordance with law on the petitioner’s representation dated 28.04.2014 seeking for referring the matter to the competent Court to enable the petitioner to get enhanced compensation in respect of the property more fully disclosed in the prayer to this writ petition, which was acquired from the petitioner under the Tamil Nadu Highways Act, 2001 by award dated 30.09.2013, within a period of four (4) weeks from the date of receipt of a copy of this order. No costs.
