Contempt proceedings stayed pending Supreme Court adjudication of underlying order.

Headnote:First Paragraph: Under Section 11 of the Contempt of Courts Act, 1971, a contempt petition was filed alleging willful disobedience of the court's order dated 12.01.2023 in W.P.No.14893 of 2018, affirmed in W.A.No.3572 of 2023. The respondent preferred a Special Leave Petition before the Supreme Court, which condoned delay, issued notice, and stayed contempt proceedings. The court found no purpose in keeping the petition pending as the matter is sub judice before the Supreme Court. Second Paragraph: The issue framed was whether to proceed with contempt proceedings despite the Supreme Court's stay order dated 08.01.2026. The court's reasoning was that the underlying order is under challenge before the Supreme Court, warranting closure of proceedings. Third Paragraph: The present Contempt Petition is closed, with liberty to revive after disposal of the Special Leave Petition.

ORDER

When the Contempt Petition is taken up for hearing, the learned Special Government Pleader appearing on behalf of the respondent submits that as against the Judgment dated 14.02.2025 in W.A.No.3572 of 2023 the respondent herein had preferred Special Leave Petition before the Hon'ble Supreme Court, and the Hon’ble Supreme Court while condoning the delay, had issued notice to the respondent / petitioner and also stayed contempt proceedings.

2. The learned Special Government Pleader submitting as above, has placed before this Court a copy of the order of the Hon'ble Supreme Court dated 08.01.2026. Since, the order of this court dated 12.01.2023 in W.P.No.14893 of 2018 as affirmed by the Division Bench of this Court in W.A.No.3572 of 2023, is sub judice before the Hon'ble Supreme Court and the Hon'ble Supreme Court having granted stay of the contempt proceedings, this Court is of the view that no useful purpose would be served in keeping the present Contempt Petition pending on the file of this Court till the Special Leave Petition before the Hon'ble Supreme Court, is adjudicated.

3. Thus, the present Contempt Petition is closed.

4. However, liberty is granted to the petitioner to seek revival of the Contempt Petition after disposal of the Special Leave Petition by the Hon'ble Supreme Court and in the event of the respondent requiring to comply with the order in the Writ Petition. There shall be no order as to costs.
