ORDER
The petitioners, claiming to be the owners of the property comprised in T.S. No. 2 (corresponding to T.S. No. 03, Ward No. 25, Block T.S. Nos. 998 and 999), measuring an extent of 1.35 acres of wet land situated in Palani Taluk, Dindigul District, had presented a sale deed executed in favour of the purchaser on 27.03.2026 for registration. However, the first respondent refused to register the said sale deed on the ground that O.S. Nos. 358 of 2018 and 545 of 2016 were pending, in which the subject property formed part of the suit schedule properties.
2. The petitioners contend that the first respondent has no authority to adjudicate upon the question of title, and that mere pendency of civil suits cannot be a ground to refuse registration unless there is an order of restraint operating against them. Therefore, the refusal to register the sale deed is arbitrary and unsustainable.
