This Writ Petition has been filed seeking issuance of a direction to the respondent authorities to ensure the burial of dead bodies of Muslim members residing in the 3rd respondent’s Jamath in the graveyard belonging to the 3rd respondent Waqf, as per the petitioner’s representations dated 16.08.2023 and 22.08.2023 addressed to the 3rd and 5th respondents herein, and to permit the same by collecting the necessary tax and fee by the 3rd respondent without any obstruction.
2. When the matter is taken up for hearing, the learned counsel appearing for the third respondent submits that they have not raised any objection to the burial of dead bodies of the petitioner’s group in the graveyard of the 3rd respondent Waqf. However, it is stated that they insist upon production of a No Objection Certificate from the respective Jamath.
