Impugned proceedings quashed for violating principles of natural justice due to lack of hearing opportunity.

O R D E R

This writ petition has been filed challenging the proceedings passed by the 3^rd respondent in Na.Ka.No.2133038(M)/2025/L1 dated 16.03.2026 and seeking consequential direction to the respondents to continue the pension paid to the petitioner prior to January 2026.

2. Heard learned Counsels appearing on either side and perused the materials available on record.

This matter earlier came up for consideration before this Court on 06.04.2026, and after hearing the counsel for the petitioner, this Court noticed that the impugned proceedings had been issued in violation of the principles of natural justice. Accordingly, this Court directed the learned Government Advocate to obtain specific instructions on this aspect.

Today, when the matter is taken up for consideration, Mr.Omprakash, learned Government Advocate, on instructions received from the 3^rd respondent, confirmed that the impugned proceedings dated 16.03.2026, was issued without complying with the principles of natural justice and without affording any opportunity to the petitioner.

In light of the above, this Court does not see any reason to keep the matter pending and this Court is of the considered opinion that the impugned order cannot be sustained for want of compliance with the principles of natural justice. Accordingly, this writ petition is allowed, and the impugned proceedings in Na.Ka.No.2133038(M)/2025/L1 dated 16.03.2026 passed by the 3rd respondent is hereby quashed solely on the ground of violation of the principles of natural justice. The respondents are at liberty to take appropriate action strictly in accordance with law. No costs. Consequently, connected miscellaneous petitions are closed.
