PRAYER :- This Appeal Suit is filed under Section 96 of the Civil Procedure Code, to set aside the judgment and decree, dated 30.06.2017 made in O.S.No.49 of 2008 on the file of the Additional District and Sessions Judge, Theni at Periyakulam, by allowing this appeal.

JUDGMENT

This Appeal Suit is filed to set aside the judgment and decree, dated

30.06.2017 made in O.S.No.49 of 2008 on the file of the Additional District and Sessions Judge, Theni at Periyakulam.

2. When the matter is taken up for hearing today (09.04.2026), both sides learned counsel submitted that the matter has been settled between the parties and a Joint Compromise Memo has also been filed along with a copy of sale deed, dated 20.02.2026. The appellant as well as the respondents 2 to 4 are present before this Court and they are identified by their respective counsel. The identity proof of the parties is also verified. The contents of the Joint Compromise Memo were read over and explained to both parties in the presence of their counsel and both parties submitted that the same were correct. Accordingly, the said Joint Compromise Memo is recorded.

3. In view of the above, this Appeal Suit is disposed of. The Joint Compromise Memo shall form part of the decree. No costs. Consequently, the connected Miscellaneous Petition is closed.
