PRAYER:-Writ Petition filed under Article 226 of the Constitution of India, praying for an issuance of Writ of Mandamus, directing the 1st respondent to consider and dispose of the representation of the petitioner dated 25.6.2020 for grant of Patta to the lands of the petitioner measuring to an extent of Acre 4.62 Cents comprised in Survey Nos. 107 / 4A1, 107 / 4A2, 107 / 7, 107 / 21, situate at Thalavaipattadai Village, Pallipattu Taluk, Tiruvallur District.

ORDER
This writ petition has been filed seeking to direct the 1st respondent to consider and dispose of the representation of the petitioner dated 25.6.2020 for grant of Patta to the lands of the petitioner measuring to an extent of Acre 4.62 Cents comprised in Survey Nos. 107 / 4A1, 107 / 4A2, 107 / 7, 107 / 21, situate at Thalavaipattadai Village, Pallipattu Taluk, Tiruvallur District.
2.Learned counsel for the petitioner would submit that the petitioner made a representation dated 25.06.2020 before the 1st respondent seeking for issuance of patta in respect of the subject property. However, the said representation of the petitioner has not been considered till date. Hence, the present writ petition has been filed.
3.Learned Additional Government Pleader appearing for the respondents would submit that O.S.No.116 of 2002 was filed in respect of the subject property, wherein the petitioner was arrayed as 2nd defendant. Against which, an appeal suit was filed and the same got decreed against the petitioner herein.
Now, the petitioner has filed a second appeal in SA.No.463 of 2003 and the same is pending. At this stage, the patta cannot be issued by the respondents.
4.Heard the learned counsel for the petitioner as well as the learned Additional Government Pleader appearing for the respondents.
5.Considering the submission made by both the parties, this Court is of the view that since the second appeal is pending with regard to the same subject property, the right course available for the petitioner is to approach the respondents through fresh application in the event the petitioner succeeds in the S.A.No.463 of 2003. Though the petitioner is in possession of the subject property at this stage he cannot seeks for a direction for issuance of patta in respect of the subject property.
6.In view of the above, this writ petition is disposed of. No costs.
