PRAYER :-Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus, directing the 3rd respondent to conclude an enquiry and take appropriate action on her complaint dated 22.09.2025 in
accordance with law within time frame as fixed by this Court.

ORDER
Seeking to direct the 3rd respondent to conclude the enquiry and take
appropriate action on the petitioner's complaint, dated 22.09.2025, this petition
is filed.
2. The learned counsel for the petitioner submitted that the petitioner has
lodged a complaint as against her husband who is working as a Police Constable at Chennai before the 2nd respondent police, pursuant to which, the petitioner's husband was also called for inquiry on 22.09.2025, on which date the petitioner had also appeared for enquiry. During the month of February, since the petitioner was in her advanced stage of pregnancy, she could not appear for enquiry. On the advice of the higher authorities of her husband, she had given in writing that no further action was required against her husband, under the fond belief that he would take care of her after the delivery of his child. However, even after delivering a girl child, there is no change in the
attitude of the petitioner's husband. Hence, this writ petition.
3. The learned Government Advocate submitted that on receipt of the
petitioner's complaint, prompt action was taken. The petitioner's husband was also called for enquiry, where the petitioner herself gave a written undertaking that no further action is necessary, and on which basis, the complaint was

closed.
4. Heard the learned counsel on either side and carefully perused the
materials available on record.
5. Considering the nature of the facts involved that the dispute is
matrimonial in nature, the 3rd respondent police is directed to reopen the complaint and summon the petitioner's husband under Section 64 BNSS and take necessary action in the manner known to law, within a period of four (4)
weeks from the date of receipt of copy of this order.
6. With the above directions, this Writ Petition stands disposed of. No
costs.
