PRAYER : Petition filed under Section 528 of BNSS, 2023 to direct the 3^rd respondent to conduct an enquiry and conclude the same pertaining to the complaint dated 04.12.2025 pending on the file of the third respondent police station based on the petitioner's representation dated 04.12.2025 within the stipulated time.

ORDER

The petitioner seeks for a direction to the 3^rd respondent to conduct an enquiry and conclude the same pertaining to the complaint dated 04.12.2025 pending on the file of the third respondent police, based on the petitioner's representation dated 04.12.2025 within the stipulated time.

The learned counsel for the petitioner submitted that the petitioner is the de facto complainant, who lodged a complaint on 04.12.2025 regarding the swindling of 40 sovereigns of gold by the fourth respondent from the petitioner’s gold jewellery shop, which is run in the name and style of Aatchi Bankers. However, there has been no progress in the investigation.

3. The learned Government Advocate appearing for the respondent police submitted that, even as of today, the petitioner has not produced any evidence in support of the claim.

4. Heard the learned counsel on either side and carefully perused the materials placed before this Court. Considering the nature of the order proposed to be passed in this petition, notice to the fourth respondent is dispensed with.

5. In view of the submission made by the learned Government Advocate, the petitioner is directed to produce adequate materials to substantiate the complaint that 40 sovereigns of gold were illegally taken away by the fourth respondent, including any available CCTV footage. The petitioner is at liberty to submit the same before the third respondent police after securing the originals. The third respondent is directed to consider the same, expedite the investigation, and complete it as expeditiously as possible, preferably within a period of two months from the date of receipt of a copy of this order.

At this juncture, the learned counsel appearing for the petitioner submitted that the third respondent police station name is mistakenly mentioned as 'Theni Police Station' instead of 'Cumbum North Police Station'. Accordingly, the name of the police station is modified as 'Cumbum North Police Station'. Registry is directed to carry out necessary amendment in this regard.

7. With the above direction, this Criminal Original Petition is disposed of.
