Revenue authorities directed to demolish unauthorized structures like security room and walls encroaching on public roads vested with Panchayat, ensuring restoration and prevention of future obstructions.

Headnote:(A) Public road vested with Panchayat under registered Gift Deed - Authorities directed to remove illegal obstructions, encroachments, compound walls, gates, fencing, security room and unauthorized constructions on 30-feet public road.

Facts of the case:
Writ petition filed seeking directions to restore public access by removing obstructions on public road vested with Panchayat. Inspection revealed partial removal of gate and one obstruction, but security room and wall remaining.

Findings of Court:
Officials directed to demolish security room, wall and any further obstructions or unauthorized constructions on panchayat land and public road within twelve weeks.

Issues: Restoration of public access by removal of remaining illegal encroachments and prevention of future obstructions.

Ratio Decidendi: Authorities must promptly remove unauthorized structures on public/panchayat lands following procedures under relevant statutes and rules to ensure public access. (Paras 2, 3, 4)

Result: Writ petition disposed of with directions. No costs.

The relief sought for in the present writ petition is to direct the respondents 1 to 7 to forthwith restore the public access by removing all the illegal obstructions.

2. Learned Additional Government Pleader would submit that inspection was conducted and the authorities identified the encroachments and unauthorised construction on the public road. The photographs produced by the learned Additional Government Pleader would show that gate alone was removed and the security room as well as the wall constructed in panchayat lands are yet to be removed. That apart, yet another obstruction caused by the private respondent was removed.

3. Learned counsel for the petitioner would submit that the security room as well as the wall constructed in the panchayat land also to be removed failing which, the private respondent will again make an attempt to cause obstruction to the usage of public road.

4. In view of the above facts, the officials are directed to demolish the security room as well as the wall wherein a gate was fixed. That apart, any further obstruction or illegal/ unauthoritised construction are made in the panchayat land as well as on the public road, the authorities are directed to remove the same by following the procedures as contemplated under the relevant statues and rules, within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above directions, the Writ Petition is disposed of . No costs.
