Mandamus directs authorities to survey and remove encroachments on public pathway land following due process.

Headnote:Under Article 226 of the Constitution of India, the petitioner sought a writ of mandamus directing authorities to remove encroachments on public pathway land classified as Sarkar Poramboke Natham in specified survey numbers. The court noted the petitioner's representation alleging encroachment by private respondents on land used as a public cart track to agricultural farms. The court directed a survey and appropriate action if encroachment is found. The primary issue was whether authorities should consider the representation and remove illegal encroachments on public land. The court accepted the Additional Government Pleader's submission that the representation would be considered via survey in the presence of parties, followed by removal if confirmed, emphasizing due process. The writ petition was disposed of with directions to conduct a survey within two weeks and take removal action, if warranted, within three months after hearing parties.

3.Mr.D.Sasi Kumar, learned Additional Government Pleader accepts notice for the respondents 1 & 2 and Mr.P.Thilak Kumar, Government Pleader, accepts notice for the third respondent. Considering the limited relief sought for by the petitioner, notice to the respondents 4 to 7 is dispensed with.
