No writ relief when revenue survey confirms no encroachment on government poramboke land.

Headnote:Under Article 226 of the Constitution of India, the petitioner sought a writ of mandamus directing removal of alleged encroachments on government poramboke land classified as “Kaundanputhur Natham Land” and “Salai (Road)” in specified survey numbers of Vairamangalam Revenue Village. The court noted that a survey conducted by the Tahsildar in the presence of the petitioner found no encroachments on the public road. The court determined that no encroachments exist as per revenue authorities' findings. The sole issue was whether directions for removal of encroachments were warranted. The court relied on the survey report confirming absence of encroachments, holding that no further action was necessary. The writ petition is closed.

[Made by S.M.SUBRAMANIAM, J., This writ petition has been filed seeking a direction to remove the encroachment made by 9th respondent in Survey Nos.23/1, 23/2, 23/3 and 23/15 correlated to the old Survey Nos.393/A1, 393/A2, 394/1 and 394/2 of the Vairamangalam Revenue Village in the Bhavani Taluk of the Erode District, which is classified as “Kaundanputhur Natham Land” and “Salai (Road)”

2. The Tahsildar, Bhavani would show that a survey has been conducted in the presence of the writ petitioner and the authorities found that there is no encroachments identified in Government Poramboke public road.

3. Since no encroachments are identified by the Revenue Authorities, no further adjudication is required in the present writ petition.
