IN THE HIGH COURT OF JUDICATURE AT MADRAS
M. NIRMAL KUMAR, J
P.Sathyanarayanan – Appellant
Versus
State Rep. by The Commissioner of Police – Respondent
Writ Petition

Advocates:
For Petitioner(s): M/s.D.Bharathy
For Respondents: Mr.Leonard Arul Joseph Selvam, Additional Public Prosecutor

Mandamus directs police enquiry completion upon petitioner's cooperation in pending complaint investigation.

Headnote:First Paragraph: Under Article 226 of the Constitution of India, the petitioner sought a writ of mandamus directing police authorities to dispose of his representation dated 09-01-2026 and initiate proceedings against private respondents. Essential facts include an earlier complaint assigned CSR No.2462 of 2022 pending over three years without action, summons issued to petitioner who failed to appear due to family emergencies. Court found police had initiated enquiry by serving summons and collecting documents from counter-petitioners, but petitioner was non-compliant. Second Paragraph: Key issue framed as whether police inaction warranted mandamus for disposal of representation and initiation of proceedings. Ratio decidendi emphasized petitioner's duty to cooperate in enquiry by appearing despite reasons provided, directing compliance within stipulated time rather than closing the matter. Last Paragraph: Writ petition disposed of with directions for petitioner to appear on 27.04.2026 and enquiry to be completed within two months.
