High Court under Art.227 directs expeditious disposal of appeals and reconstruction of misplaced records with timelines.

ORDER

This revision seeks for expeditious disposal of A.S.No.66 of 2014 pending on the file of the learned Subordinate Judge at Sivagangai.

2. By an order dated 02.04.2026, I requested the learned Subordinate Judge to send a report as to why an appeal of the year 2014 is still kept pending. The learned Subordinate Judge sent a report dated 10.04.2026, stating that the original of the judgment and decree in O.S.No.130 of 2010 dated 10.01.2014, on the file of the learned District Munsif cum Judicial Magistrate at Thiruppathur, had been misplaced by the said Court. He assured that after getting the original decree and judgment in O.S.No.130 of 2010 from the learned Trial Judge, he will dispose of the appeal within a month from that date.

3. I was surprised that official records have gone missing. Hence, I requested the learned District Munsif cum Judicial Magistrate, Thiruppathur, to state as to why the original records have gone missing. I posted the matter today for the report.

4. The learned Principal District Munsif cum Judicial Magistrate, Thiruppathur, has sent a report dated 24.04.2026, stating that the person responsible for the records was removed from service on 05.12.2014. Subsequently, he has issued notice to the counsel, calling upon them to produce the photostat copy of the judgment and decree in O.S.No.130 of 2010, so as to enable the Court to re-construct the same. Both the counsel had filed a memo before him stating that they do not have copies nor any instructions from the parties. Thereafter, the learned Trial Judge has sent notice to the parties themselves. The plaintiff, Mr.Arumugam, who is the civil revision petitioner, has produced a photostat copy of the judgment and decree in O.S.No.130 of 2010. The first defendant pleaded that he does not have a copy of the same. The second defendant, being a police official, had cited election duty and sought for adjournment. The learned Trial Judge has posted the matter today to receive the objections on re-construction. He has assured this Court that by today (27.04.2026), he will re-construct the original judgment and decree and send the same to the learned Subordinate Judge, Sivagangai, by 29.04.2026

5. The learned Principal District Munsif cum Judicial Magistrate, Thiruppathur shall do the needful, as stated in his report dated 24.04.2026. On receipt of the records on 29.04.2026, the learned Subordinate Judge, Sivagangai, shall dispose of A.S.No.66 of 2014 by 30.06.2026

6. With the above directions, this Civil Revision Petition stands disposed of. There shall be no order as to costs.
