IN THE HIGH COURT OF JUDICATURE AT MADRAS

K.G.Somasundaram – Appellant
Versus
Consumer Grievance Redressal Forum rep by its Chairman-cum-Superintending Engineer, Tirupur Electricity Distribution Circle, Tamil Nadu Generation and Distribution Corporation Limited – Respondent
Writ Petition

Advocates:
For the Petitioner(s): No appearance
For the Respondent(s): Mr.L.Jai Venkatesh Standing Counsel

Writ petition dismissed for non-prosecution and non-exhaustion of available appeal remedy.

Headnote:The petitioner filed a writ petition under Article 226 of the Constitution seeking to quash orders passed by the Consumer Grievance Redressal Forum and related authorities concerning electricity distribution matters. The court noted the challenge to the forum's order. Respondents submitted that an appeal remedy was available, which the petitioner failed to exhaust before approaching the court. The court observed that it was disinclined to entertain the petition due to the availability of alternative remedies. Issues framed included whether the writ petition was maintainable without exhausting appeal provisions. The ratio decidendi emphasized that writ jurisdiction under Art.226 should not be invoked bypassing statutory appeal remedies. The writ petition was dismissed for non-prosecution due to non-appearance of the petitioner.
