Driving licence retention justified temporarily for accident enquiry; must be returned post-verification.

ORDER

In this matter, the grievance of the petitioner is that the petitioner's driving licence has been withheld by the second respondent.

2.When the matter came up for admission, the learned Government Advocate (Criminal Side) and the learned Special Government Pleader, taking notice on behalf of the respondents, would submit that the petitioner's vehicle was involved in an accident and as such, a case in Crime No.76 of 2026 was registered by the Kallimandayam Police Station, Dindigul District for the alleged offences under Sections 281 and 125(a) of BNS 2023. It is further submitted that the licence has been retained only for the purpose of enquiry and verification and that the same will be returned to the petitioner on completion of the enquiry.

3.In view of the same, by directing the respondents to complete the enquiry and thereafter return the original licence of the petitioner within a period of four weeks from the date of receipt of the web copy of this order, the Writ Petition stands disposed of. No costs.
