O R D E R
The present Writ Petition has been filed seeking issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned order passed by the 2nd respondent dated 03.04.2023 bearing Ref. No.FIN/PEN/PPO No.526/2022-23/01, to quash the same and consequently direct the respondents to pay family pension to the petitioner.
2. The petitioner herein is claiming payment of family pension on the ground that she is a divorced daughter of Late.Krishnan Nair, who worked in the respondent Coffee Board at Coimbatore and retired from service on 31.03.1985. The said request made by the petitioner was rejected by the respondents in the impugned proceedings dated 03.04.2023, on the ground that the divorce proceedings of the petitioner had been initiated only after the death of her mother and, therefore, she cannot be regarded as falling within the category of a divorced daughter and is consequently not eligible for payment of family pension.
