Passport date of birth correction mandated based on Aadhaar and PAN as valid identity proofs per guidelines.

ORDER

The petitioner is before this Court seeking for a direction to correct the petitioner's date of birth in the passport bearing No.V4267974 to re-issue the passport pursuant to the representation dated 13.03.2026. 2. The petitioner stated that in the passport, his date of birth was inadvertently mentioned as 16.10.1969 instead of 05.02.1976. Subsequently, he has obtained public documents like Aadhar Card and PAN card in which the date of the birth of the petitioner is mentioned as 05.02.1976 and therefore submitted an application with the respondent to correct the date of birth in the passport and re-issue the same.

3. The Ministry of Home Affairs, Government of India, has issued guidelines/circulars prescribing the documents that may be produced for issuance or correction of passport particulars. As per the said guidelines, documents such as Aadhaar Card, Elector’s Photo Identity Card (EPIC), Service Identity Card issued by the State or Central Government, Birth Certificate issued under the Registration of Births and Deaths Act, and other specified documents can be relied upon.

3. In the present case, the petitioner has produced copies of Aadhar Card and PAN card which indicate the petitioner's date of birth as 05.02.1976. The said documents are recognized as identity documents and form part of the acceptable proof for establishing the date of birth.

4. In view of the above, this Court is of the opinion that the respondent is bound to consider the petitioner's request for correction of date of birth based on the documents provided subject to verification in accordance with law.

Accordingly, this Writ Petition is disposed of directing the respondent to consider the petitioner's request and to re-issue the passport by correcting the date of birth as 05.02.1976 instead of 16.10.1969 in passport bearing No.V4267974 dated 09.06.2022 subject to the petitioner satisfying all other requirements.

6. The said exercise shall be completed within a period of four (4)

weeks from the date of receipt of a copy of this order.

7. There shall be no order as to costs.
