For the Respondents: Mr.S.A.Ajmalkhan, Mr.G.Mathavan

Court directed joint trial of related suits post-restoration, in line with prior transfer orders under supervisory jurisdiction.

Headnote:The petitioner filed Civil Revision Petitions under Article 227 of the Constitution of India seeking directions for joint trial of O.S.Nos.267/2023, 268/2023 and 270/2022 pending before the I Additional District Judge, Madurai, following prior transfer orders dated 08.06.2023 in Tr.C.M.P(MD) Nos.183 and 184 of 2023. The court noted that O.S.No.270/2022 was dismissed for default but subsequently restored on 08.04.2026. The court directed joint trial of the suits. Issues framed involved whether joint trial could be directed post-restoration of the lead suit. The court relied on its prior transfer directions, holding that joint disposal was appropriate given common issues. The Civil Revision Petitions were disposed of with directions for joint trial and disposal within nine months.

COMMON ORDER

Heard Ms.C.Muneeswari representing for Mr.M.Ramu for the petitioner, Mr.S.A.Ajmalkhan for the first respondent and Mr.G.Mathavan for the second respondent.

2.The petitioner seeks for a direction for a joint trial of O.S.No.267 of 2023, O.S.No.270 of 2022 and O.S.No.268 of 2023, all of which are said to be pending on the file of the I Additional District Judge at Madurai.

3.Earlier to these revisions, two applications had been moved in Tr.C.M.P(MD).Nos.183 and 184 of 2023, seeking orders of this Court to withdraw O.S.No.277 of 2022 and O.S.No.295 of 2022 pending on the file of the District Munsif Court at Melur and to transfer the same to be heard and tried along with O.S.No.270 of 2022, which was then pending on the file of the Principal District Judge at Madurai.

4.This Court, by an order dated 08.06.2023, allowed the withdrawal of O.S.Nos.277 and 295 of 2022 and directed the same to be tried along with O.S.No.270 of 2022 by the learned Principal District Judge at Madurai. In compliance with the orders, the suits were withdrawn and renumbered as O.S.Nos.267 and 268 of 2023.

5.Just prior to the filing of the present revisions, O.S.No.270 of

2022 had been dismissed for default on 06.10.2025. When the suit has been dismissed for default, obviously, I cannot give the direction, which the petitioner seeks in these revisions. Hence, I called upon Mr.M.Ramu to get the suit restored on to the file of the learned I Additional District Judge, Madurai, for which, I granted time and posted the matter today (10.04.2026).

6.Today, when I took up the matter, Ms.C.Muneeswari and Mr.S.A.Ajmalkhan report that applications for restoration had been filed and the same had been allowed by the Court on 08.04.2026 and all the suits are posted for further proceedings on 15.04.2026.

7.In the light of the directions given by this Court in Tr.C.M.P(MD).Nos.183 and 184 of 2023 dated 08.06.2023, the learned First Additional District Judge is requested to try all the suits together and dispose of the same within a period of nine(9) months from today (i.e., on 10.04.2026).

8.Ms.C.Muneeswari reports that the civil revision petitioner will not object to the petition filed for receipt of additional documents presented by the plaintiffs in O.S.No.267 of 2023. The statement is recorded.

9.With the above directions, these Civil Revision Petitions are disposed of. Consequently, connected Miscellaneous Petitions are closed.
