PRAYER: Criminal Original Petition is filed under Section 528 of BNSS Act, to directing the 1 and 2 respondents to provide adequate police protection to the petitioner for his life and limb to continue his business activities peacefully in the above said premises from 3 to 5 respondents and their men based on the

petitioner's representation dated 14.03.2026.

ORDER

The present petition has been filed seeking a direction as against the

respondents 1 and 2 to provide adequate police protection to the petitioner from

the threat of the respondents 3 to 5.

2. Admittedly, the third respondent is the owner of the building. The 4th

and 5th respondents are her daughter and son. The petitioner claims that he is the tenant of the premises. According to him, at the instigation of the landlord, a demolition notice has been issued by the Corporation. The said notice has been stayed by this Court in W.P.(MD)No.6015 of 2026 at the instance of the present

petitioner.

3. The petitioner has also filed O.S.No.105 of 2024, before the Special

Court for trial of SC/ST cases, Dindigul, seeking specific performance in which

the respondents 3 to 5 have already filed the written statements.

4. According to the learned Counsel appearing for the petitioner, in the

meantime, the respondents 3 to 5 have entered into the property and damaged the articles therein and attempted to take possession. They are also threatening

him with dire consequences. Hence, the present petition.

5. Considering the above said facts, the second respondent is directed to

provide adequate police protection to the life and limb of the petitioner. As far as the other issues relating to possession are concerned, they have to be decided

by the competent civil Court.

6. With the above said observations, this Criminal Original Petition

stands disposed of.
