ORDER

The writ petition has been filed seeking to quash the impugned transfer

order passed by the second respondent vide Rc.No.A1/4430/2026 R.O. No.145/2026 dated 13.03.2026 transferring the petitioner from TSP II Battalion,

Avadi to TSP I Battalion, Trichy.

2. The petitioner had joined the Police Department as Grade II P.C. on

16.03.1994, and by subsequent promotions, he was promoted as Head Constable in 1999 and Sub Inspector of Police in September 2007. Thereafter, in April 2020, he was promoted as Inspector of Police, Motor Transport Officer (MTO) ,and his first posting was at TSP XVth Battalion, Sevoor Vellore District. Thereafter, he was transferred to various Battalion, the details of

which are as follows :

3. While so, he is now transferred to TSP I Battalion, Trichy vide impugned

order of the first respondent dated 13.03.2026. Aggrieved by the present transfer which has taken place within a period of six months of his previous transfer, the petitioner is before this Court to quash the impugned transfer order.

4. The petitioner would submit that his wife is presently working in TSP, V

Battalion, Avadi as Sub Inspector of Police and his son is studying in Engineering College at Chennai and his final year examinations are scheduled to be held in April, 2026. That apart, his mother who is aged 90 years is suffering from age old ailments and there is nobody to take care of his mother. Therefore, the present transfer is creating mental stress, both to him and to his

family members.

5. The grievance of the petitioner is that when he was posted at

Pochampalli TSP VII Battalion, he has sought for a transfer to Avadi Battalion, in terms of the G.O.Ms.No.930 dated 26.07.1977, and Circular Memorandum

dated 26.10.2023 issued by the DGP Head of Police Force, on the ground that his wife, who is also a Government employee, is posted at Avadi Battalion. The same was considered and accordingly, the petitioner was transferred from Pochampalli to Avadi II Battalion, Tamil Nadu. However, within a short span of six months, he was issued with a transfer proceedings to Trichy TSP I

Battalion.

6. The petitioner would submit that his present transfer was on account of

transfer of one N.Ravichandran, who is on punishment, now working in Trichy Battalion to Avadi Battalion, and vice-versa, the petitioner was asked to report before Trichy with immediate effect.
