Gandhi Raj, Special Government Pleader, for R-1 to R-3 Prayer: Writ Petition, filed under Article 226 of the Constitution of India, praying this court to issue a WRIT OF CERTORAIFIED MANDAMUS to call for the records on the file of the 2nd Respondent in connection with the Impugned enquiry report vide his proceedings in Na.Ka.No.A2/1126/2025 dated 12.03.2025 quash the same as illegal and arbitrary and consequential direct the respondents 1 to 3 to grant patta in the petitioner name on the Survey Nos. 196/12, 204/5, 204/9, 204/10, 205/1, 205/8, 205/13, 206/3 216/1, 263/2, 263/3, 263/9, 263/14 265/1, 265/3, 265/8, 265/10, 265/13 and 265/15 situated in Navalurkuttapattu village, Srirangam Taluk, Tiruchirappalli District, based on the registered WILL in Document No. 34 of 1977 on the file of Joint Registrar, Thiruchirappalli District by conducting fresh enquiry after affording due opportunity to all private parties within the time limit stipulated by this Court.

ORDER

The present writ petition is filed to quash the impugned enquiry report vide proceedings dated 12.03.2025 as illegal, and consequently to direct respondents 1 to 3 to grant patta in the petitioner’s name for Survey Nos. 196/12, 204/5, 204/9, 204/10, 205/1, 205/8, 205/13, 206/3, 216/1, 263/2, 263/3, 263/9, 263/14, 265/1, 265/3, 265/8, 265/10, 265/13, and 265/15 situated in Navalurkuttapattu Village, Srirangam Taluk, Tiruchirappalli District, based on the registered Will in Document No. 34 of 1977.

2. The contention of the petitioner is that the petitioner’s grandfather, namely C. Velayutham Udayar, was the owner of the subject properties based on the registered Will registered in Document No. 34 of 1977. The grandfather had executed the Will in favour of the petitioner. He owned several lands. The other legal heirs have been arrayed as respondents 4 to 8. They were granted patta, however, the respondents have refused to grant patta in the name of the petitioner alone.

3. In the impugned order, it is stated that the petitioner’s grandfather, namely C. Velayutham Udayar, was not reflected in the computerised Patta and Chitta, nor in the Village ‘A’ Register. However, the petitioner has produced the Village Register. This Court has scrutinised the same, wherein, in Survey No. 265, the name of C. Velayutham Udayar is entered against several properties. Therefore, the reasons stated in the impugned order indicate total non-application of mind.

4. Moreover, the learned counsel appearing for the petitioner submitted that the respondents have granted patta to other legal heirs, who are also legal heirs of the said C. Velayutham Udayar. It is unclear how the petitioner alone is not entitled.

5. Therefore, the impugned proceedings dated 12.03.2025 passed by the

2nd respondent are set aside. The respondents are directed to issue notice to the petitioner as well as respondents 4 to 8 and conduct an enquiry. The petitioner is directed to produce the ‘A’ Register and Will before the respondents along with other relevant records. After examining the same, the respondents shall pass orders in accordance with law. The said exercise shall be completed within a period of five months from the date of receipt of a copy of this order.

6. With these observations, this writ petition is disposed of. No costs.

Consequently, connected miscellaneous petition is closed.
