1st Defendant Prayer : This Transfer Civil Miscellaneous Petition filed under Section 24 C.P.C., to withdraw the case in O.S.No.280 of 2024 on the file of the Sub Court, Melur and transfer the same to Sub Court, Madurai.

ORDER

The Transfer Civil Miscellaneous Petition is filed to withdraw the case in O.S.No.280 of 2024 on the file of the Subordinate Court, Melur, and transfer the same to the file of the Subordinate Court, Madurai.

2. Heard the learned counsel appearing for the petitioner, the learned counsel appearing for the first respondent and the learned counsel appearing for the second respondent.

The learned counsel appearing for the petitioner would submit that the suit property is situated in Veerapanjan Village and the District Munsif Court at Madurai Taluk alone is having territorial jurisdiction and that therefore, the petitioner was constrained to file the present transfer petition.

4. When the matter was taken up 10.03.2026, after hearing the learned counsel on either side, this Court directed the Registry to get a report from the learned Principal District Judge, Madurai, as to whether Veerapanjan Village falls under the jurisdiction of Melur or Madurai. In pursuance of the same, the learned Principal District Judge, Madurai, submitted a report dated 13.03.2026 stating that civil jurisdiction is District Munsif Court, Madurai Taluk @ Madurai and criminal jurisdiction is Judicial Magistrate Court, Melur (Othakadai PS). Since Veerapanjan Village falls within the territorial jurisdiction of the District Munsif Court, Madurai Taluk @ Madurai, the Court at Melur does not have jurisdiction to try this suit.

At this juncture, the learned counsel appearing for the first respondent would submit that two other suits in O.S.Nos.81 of 2024 and 104 of 2024 are pending on the file of the District Munsif Court, Madurai Taluk and all the suits may be directed to be tried at Madurai Court and joint trial may be ordered.

Considering the facts and circumstances, this Court is of the view that the case in O.S.No.280 of 2024 is ordered to be withdrawn from the file of the Subordinate Court, Melur, and transfer the same to the file of the Subordinate Court, Madurai. Accordingly, the learned Subordinate Judge, Melur, is hereby directed to transmit the entire records in O.S.No.

280 of 2024 to the file of the Subordinate Court, Madurai, within a period of 10 days from the date of receipt of a copy of this order and on receiving the case bundle, the learned Subordinate Judge, Madurai, is directed to take up the petition on file and proceed in accordance with law.

7. Since the above said two suits in O.S.Nos.81 of 2024 and 104 of

2024 are pending on the file of the District Munsif Court, Madurai, the parties are at liberty to file a transfer petition before the concerned District Court and it is for them to approach the trial Court for joint trial.

8. With the above direction, the Transfer Civil Miscellaneous Petition is allowed. Consequently, connected Miscellaneous Petition is closed. No costs.
