Mrs.V.Pushpalatha, Advocate C.M.A.No.82 of 2026 This Civil Miscellaneous Appeal has been filed under Section 173 of Motor Vehicles Act, 1988, against the fair and decreetal award passed by the learned Motor Accident Claims Tribunal(III Court of Small Causes, Chennai) dated 14.08.2024 in M.C.O.P.No.6818 of 2017.

Both the parties are present. M/s.M.Malar, learned counsel for the appellant and Mr.D.Bhaskaran, learned counsel nd for 2 respondent/Insurance Company are present. After mutual discussion, negotiation, mediation and conciliation between both parties, they arrived at a compromise to settle the matter as follows:

TERMS OF SETTLEMENT The appellant has preferred this Civil Miscellaneous Appeal seeking to enhance the Award dated 14.08.2024 in M.C.O.P.No.6818 of 2017 passed by the learned Motor Accident Claims Tribunal (III Court of Small Causes, Chennai).

2. The Tribunal has passed an award of Rs.1,49,100/-

with interest at the rate of 7.5% per annum from the date of petition till the date of deposit along with cost.

3. The parties are present along with their respective counsels. The appellant has preferred the present Civil Miscellaneous Appeal for enhancement of award amount. 4. After great deliberation and discussion, both the parties have agreed for enhancement of award amount with further additional sum of Rs.1,50,000/- (rupees one lakh fifty thousand only) in full quit (inclusive of interest).

5. In view of the compromise arrived at between the parties, the National Lok Adalat hereby declare and decree nd that 2 respondent/Insurance Company shall deposit the enhanced award amount of Rs.1,50,000/- (rupees one lakh fifty thousand only) in full quit (inclusive of interest), within a period of six weeks from the date of receipt of a copy of this award. On such deposit, the appellant is permitted to withdraw the enhanced award amount immediately, without filing any formal petition, before the competent Court.

6. The Tribunal is directed to transfer the above said award amount to the Bank accounts of the claimant by way of NEFT / RTGS, on proper identification, in accordance with the terms of the award, without insisting on any formal permission petition.
