Prayer:- Writ petition filed under Article 226 of the constitution of India praying for issuance of a writ of certiorarified mandamus calling for the entire records relating to the impugned order of the 1st Respondent dated 27.02.2026 in Na.Ka. No.262/2023/Q2 and quash the same and consequently direct the 1st Respondent to retain the Petitioner in the Government Boys Higher Secondary School, Valparai Municipality, Coimbatore District by considering her representations dated 28.02.2025, 17.03.2025.

ORDER

This Writ Petition has been filed for the following reliefs:-

“calling for the entire records relating to the impugned order of the 1st Respondent dated 27.02.2026 in Na.Ka. No.262/2023/Q2 and quash the same and consequently direct the 1st Respondent to retain the Petitioner in the Government Boys Higher Secondary School, Valparai Municipality, Coimbatore District by considering her representations dated 28.02.2025, 17.03.2025.” Brief Facts:-

2. The petitioner would submit that she was appointed as Noon Meal Organizer on 24.08.2012 in the Government Girls Higher Secondary School, Valparai Municipality, Coimbatore District.

The petitioner would submit that, considering her family circumstances, health issues of her husband and personal difficulties she requested transfer to the Government Boys Higher Secondary School, Valparai Municipality, Coimbatore which is situated near her residence. In this regard, she had made representations on 28.02.2025 to the 2nd respondent and on 17.03.2025 to the Ministry for Social Welfare & Women Empowerment, Chennai.

The petitioner would further submit that, the 2nd respondent by proceedings dated 19.09.2025, placed her under additional charge as Noon Meal Organizer in the Government Boys Higher Secondary School, Valparai, where she has been working since then to the satisfaction of the authorities. The Headmaster of the said school, had sent a communication dated 23.01.2026 to the 2nd respondent recommending her appointment as permanent Noon Meal Organizer in the Government Boys Higher Secondary School, Valparai.

While so, the 1st respondent, by proceedings dated 27.02.2026, had issued transfer orders affecting 22 persons, including the 3rd respondent herein and posted the petitioner back to the Government Girls Higher Secondary School, Valparai Municipality. The petitioner would submit that the impugned transfer order has been passed without considering her representations, the recommendation of the Headmaster dated 23.01.2026 and her husband’s health and family circumstances. Aggrieved thereby, the petitioner has filed the present writ petition.

6. Heard the learned counsel on either side and perused the records.

7. The petitioner seeks to challenge her transfer on the ground that the same has been passed overlooking her representations, the recommendation of the Headmaster of the Government Boys Higher Secondary School, Valparai dated 23.01.2026, and her husband’s health and family circumstances. It is her case that her husband is a heart patient and she has two children, and therefore the Government Boys Higher Secondary School, Valparai, which is situated about half a kilometre from her residence, is more suitable for her.

8. However, the learned Government Pleader would submit that the petitioner has been transferred to a place which is only about 15 kilometres from her residence and, being a Noon Meal Organizer, her working hours are between 9 a.m. and 5 p.m., and t
