J U D G M E N T

This intra-Court appeal has been directed against the order dated
28.02.2024 made in W.P.No.13994 of 2020.
2. The first respondent herein was writ petitioner, who participated in the
selection process for the post of B.T.Assistant (Chemistry) conducted in the year 2012. The said selection was made only on the basis of the marks obtained in Teachers Eligibility Test followed by certificate verification. The first respondent / writ petitioner was having the qualification of B.Sc (Applied Chemistry) and B.Ed based on which after having verified the certificate, the Teachers Recruitment Board seems to have found that, the qualification of B.Sc (Applied Chemistry) might not be equivalent to the required qualification of B.Sc (Chemistry), therefore, on the basis of the said doubt arisen, the first respondent / writ petitioner was not considered for appointment during the
relevant point of time.

3. Thereafter, the first respondent / writ petitioner approached this Court
and filed writ petition in W.P.No.219 of 2020, wherein on the basis of the Government Order subsequently issued by the Government in G.O.(Ms)No.65, Higher Education (K2) Department dated 24.04.2019 whereby the equivalence between these two degrees since have been declared as if that B.Sc (Applied Chemistry) is equivalent to B.Sc (Chemistry), a direction was given by the writ Court to consider the candidature of the first respondent / writ petitioner to accommodate her in any one of the vacancies. Subsequently, it seems that, for want of vacancy, even that direction given by the writ Court was not complied
with.
4. However, it was subsequently found out by getting an information
under Right to Information Act that, there was one vacancy in B.T.Assistant (Chemistry), therefore, very well, the writ petitioner could have been accommodated, only at that circumstances, she approached this Court again by filing the present writ petition in W.P.No.13994 of 2020 which was allowed
through the impugned order dated 28.02.2024.
5. Assailing the said order, Mr.R.Neelakandan, learned Additional
Advocate General appearing for the appellant would contend that, on two grounds, the request made by the first respondent / writ petitioner to

accommodate her in the vacancy for the post of B.T.Assistant (Chemistry) for the year 2012 had been rejected. The first ground is that, insofar as the qualification is concerned, she admittedly got the degree of B.Sc (Applied Chemistry) whereas the qualification required was B.Sc (Chemistry) and though this has been made as an equivalent only in G.O.
