JUDGMENT
(Judgment of the Court was made by G.R.SWAMINATHAN, J.)
The unsuccessful writ petitioner is the appellant herein. The
petitioner sought mutation of patta in his favour in respect of the petition mentioned land. The learned Single Judge vide order dated 29.08.2024 relegated the petitioner to go before the jurisdictional Civil Court.
Aggrieved by the same, this writ appeal has been filed.
2. When the matter was taken up for hearing, the learned counsel
for the private respondent pointed out that after filing W.P.(MD)No.9530 of 2024, the appellant filed W.P.(MD)No.12423 of 2024. The said writ petition was taken up on 18.07.2024. Incidentally, it came before one of us (GRSJ). The prayer in the said writ petition was for conducting
survey. The writ petition was disposed of as follows:- “2. The petitioner obtained an order for conducting survey.
Admittedly, the petitioner is not having separate patta. But this is a case of joint patta. Co-pattadars are raising objections. The civil suit is also pending. There are several factual aspects are involved. The petitioner has to establish his rights only before the jurisdictional civil Court. Granting such liberty to the petitioner, this writ petition stands
disposed of.”

3. Though the prayer in W.P.(MD)No.12423 of 2024 and W.P.
(MD) No.9530 of 2024 are different, the core issue basically pertains to the appellant's right over the land in question. The learned single Judge had rightly taken the view that the matter has to be established only before the jurisdictional civil Court. In fact, the very same view had been taken in W.P.(MD)No.12423 of 2024 also. Interference with the
said order is not called for. The Writ Appeal is dismissed. No costs.
