O R D E R
This writ petition is filed for the following relief:
“To call for the impugned order passed by the 2nd respondent in P.H.V.C.D.C.No.MI/752/2023 dated 12.04.2024 and quash the same and consequently direct the respondents herein to promote the petitioner as Junior Entomologist and as Senior Entomologist with effect from the date on which the petitioner's Junior Tmt. Thenmozhi got her promotion as Junior Entomologist and Senior Entomologist with all monetary and other attendant benefits including enhancement in the pension.”
2. The petitioner was appointed as a Lab Assistant in the year
1986. The petitioner retired from service as a Senior Entomologist in Zone 15, Corporation of Greater Chennai, Chennai on 30.06.2018 on attaining the age of superannuation.
3. The petitioner would submit that his promotion was denied on the allegation that there was a charge pending against him. The petitioner would submit that a charge memo was issued on 10.08.2000 and the same came to an end by imposing a punishment of stoppage of increment for one year without cumulative effect by an order dated 13.04.2003. The petitioner would submit that he was entitled to be considered for promotion in the year 2005, however, he was considered only in the year 2007. Therefore, the petitioner is before this Court.

A counter affidavit has been filed by the 2nd respondent for himself and on behalf of the 1st respondent, wherein he would submit that the petitioner had joined the service of Chennai Corporation on 12.05.1986, as a Lab Assistant through Employment Exchange. Thereafter, he was promoted as an Entomologist Assistant on 25.12.2007 and a Senior Entomologist on 12.02.2016. The petitioner retired from service on 30.06.2018, on attaining the age of superannuation and within a period of 1 year from the date of his retirement, an audit objection was raised. Thereafter, DCRG was sanctioned on 12.12.2019 and the attempts to handover the cheque to the petitioner was unsuccessful.
5. The petitioner had thereafter filed a writ petition in WP.No.32484 of 2019, seeking a mandamus directing the respondents to forthwith settle the DCRG amount with interest. The bank details were also furnished. Thereafter, the petitioner’s retirement benefits were transferred with 6% interest from 01.07.2018 till 30.11.2019. 6. The respondents would submit that while the petitioner was serving as a Lab Assistant a charge memo dated 28.06.2000 was issued under provision 9 (2) of Chennai Corporation Class III and IV Scheme (Discipline and Appeal) Bye-laws, on account of negligence in collecting the blood samples from the patients in the Communicable Diseases Hospital, Tondairpet.
